Living Mixtape LLC ("Living Mixtape," "we," "us") is a Colorado company that helps working musicians turn live shows into lasting fan relationships. This policy explains what information we collect, what we do with it, and the choices you have. It covers everyone who touches Living Mixtape: fans who request songs, tip, or follow an artist; artists on our roster; applicants to the roster; and visitors to our websites.
1. The short version
- We never sell your information. Not to advertisers, not to data brokers, not to anyone. We don't run ad trackers or ad pixels on our sites or in our app.
- Your fan relationship belongs to the artist. When you request a song or tip an artist, your contact info goes to that artist's fan list — not to a shared pool every artist can see.
- We only text or email you if you said yes — and only on the channel and topic you said yes to. Reply STOP to any text and it stops.
- You can ask us to see, correct, send you a copy of, or delete your information — see §10.
2. What we collect
If you're a fan (you requested a song, tipped, or followed an artist):
- Your name, phone number, and email — what you give us on a request or tip page.
- Your activity on Living Mixtape: songs you requested, shows you attended, artists you follow, tips you've sent (amounts and dates — your card number goes to our payment processor, Stripe; we never see or store full card numbers).
- Your consent records: which boxes you checked, when, and the exact wording you saw. We keep these because they're your instructions to us — they're how we prove we only message people who said yes.
If you're an artist on the roster:
- Account info: name, stage name, email, phone, your page content (photos, songlist, links).
- Money info: your subscription (billed through Apple's App Store or Stripe), and tip payouts through Stripe Connect. Stripe — not us — collects and holds the identity and bank details required by financial law; we see payout status, not your banking credentials.
- Your fan list and how your shows perform (requests, tips, follows).
- If you order printed materials: your order details and shipping address, shared with our print fulfillment partner only to produce and deliver your order.
- If you use the mileage log (Main Stage): your home address, used only to estimate the round-trip distance to your shows. It's stored privately and isn't shared or shown to anyone else.
If you're an applicant: what you put on the application — name, contact info, links to your music — plus your agreement to the roster commitments (version, time, and where you applied from). If you weren't approved and asked us to invite you later, we store your email for that one purpose.
If you just visit our sites: almost nothing. We use only essential cookies (the kind that keep a sign-in session working), plus privacy-first analytics (GoatCounter) that count page visits without cookies, without storing your IP address, without tracking you across the internet, and without building a profile of you. No ad trackers, ever.
What we don't collect: passwords (sign-in is by emailed link and code), precise GPS location, contacts from your phone, or anything from your device beyond what the app needs to work.
3. How we use your information
- To run the show: deliver song requests to the artist, confirm your request by text, process tips, show the artist their setlist and fan activity, and produce and ship print orders.
- To message you — only per your consents: texts about your requests and that artist's shows (the box you checked when you made a request), and — only if you separately opted in — occasional texts/emails from Living Mixtape about shows near you, venues you've visited, and other Living Mixtape artists.
- To run accounts: sign-in links and codes, receipts, payout notices, important service announcements.
- To keep things safe and lawful: fraud prevention, moderating fan-submitted notes, honoring opt-outs, keeping required records.
- To improve Living Mixtape: we look at how the product is used in aggregate (e.g., "requests per show"), not to profile individuals for advertising.
4. Your activity across artists
If you follow more than one Living Mixtape artist, you can see your own history across all of them in one place (your shows, requests, and tips — your "front row pass"). This view is yours alone:
- Artists can't see it. Each artist sees only their own fan list and your activity with them. We never tell one artist what you do with another.
- We don't market off it without your permission. Recommendations of new artists and any Living Mixtape outreach happen only if you opted into discovery (§3) — and even then, our messages never reveal which other artists you follow.
5. Who sees your information
- The artist you engaged with. Your name, contact info, requests, and tips go to that artist — that's the point of the product. Artists agree to our rules: they may use their fan list to reach their own fans and may export it, but they may not sell it or use it to spam you, and your opt-outs bind them too.
- Service providers who help us run the product, under contracts that limit them to working for us — including: Stripe (payments, tips, payouts, and the identity/tax requirements that come with them), Apple (App Store and in-app subscription billing), Cloudflare (hosting and storage), GoatCounter (our privacy-friendly website analytics — cookieless, no stored IP address, no cross-site tracking), GoHighLevel (the system that sends our texts and emails and stores fan contact records), and our print fulfillment partner (which receives an artist's name, shipping address, and print files — only to produce and ship their order).
- Nobody else, except when the law genuinely requires it (a valid legal demand), to protect safety, or — if Living Mixtape is ever acquired or merged — a successor bound by this policy. We never sell or rent your information, and we don't share it for targeted advertising.
6. Texts and emails — the rules we hold ourselves to
- Every checkbox starts unchecked. Saying no to marketing never blocks you from requesting a song.
- Texts about your requests and an artist's shows are sent by Living Mixtape on behalf of that artist. Discovery texts/emails (other artists, venues) only happen with your separate opt-in.
- Reply STOP to any text to stop texts from that line; reply HELP for help. Every marketing email has an unsubscribe link. Opt-outs take effect immediately.
- Marketing texts only go out 9am–8pm your local time. (Confirmations of something you just did — like a request — arrive right away, whatever the hour, and contain no marketing.)
- Message and data rates may apply, per your carrier.
7. How long we keep things
- Fan and artist account data: as long as the account/relationship is active, then deleted or anonymized on a schedule.
- Consent and opt-out records: 5 years after our last message to you — even if you delete your account. If anyone ever claims we texted without permission, this record is how we prove we didn't (or find and fix it if we did). It's kept to the minimum needed for that proof.
- Payment records: kept by Stripe and by us as financial law requires.
8. Deleting your account
Artists can delete their account from inside the app; anyone can ask us to delete their information by emailing us (§14). When you do, we remove your profile, content, and activity — not just hide them. Three things stay, because the law or your protection requires them: the consent/opt-out record (§7), payment records financial law makes us keep, and anything under an active legal hold. If you opted out of texts before deleting, that opt-out stays honored.
9. If an artist leaves Living Mixtape
Artists can export their own fan list and take it with them — that's our promise to them, and those contacts are governed by the artist's own obligations after that (our consent and opt-out records go with the handoff, so your choices travel with your info). We don't keep marketing to a departed artist's fans; any Living Mixtape-level contact still requires your own opt-in with us.
10. Your choices and rights
Anyone, anywhere: you can ask us what we have about you, ask us to correct it, send you a copy, or delete it (§8), and you can withdraw any consent at any time (STOP, unsubscribe, or email us). We honor opt-outs right away; for other requests, we'll confirm it's really you (usually by checking control of the email or phone on file) and take care of it as promptly as we reasonably can.
Colorado residents (and residents of other states with privacy laws): where these laws apply to us, you also have the rights they give you — to access, correct, delete, and get a portable copy of your data, and to opt out of targeted advertising and sales (which we don't do anyway). We won't discriminate against you for exercising any right, and we'll respond in the timeframe the law requires. Email us to make a request (§14).

11. Security
Sign-in is passwordless — an emailed link and a short code — so there's no password to steal. Payment card and bank details live with Stripe, a certified payment processor, not on our servers. Data is encrypted in transit, access inside the company is limited to people who need it, and our texting system is registered with carriers under the rules for business messaging. No system is perfect; if a breach ever affects your data, we'll notify you as the law requires.
12. Age
Living Mixtape isn't for children. Our services are for people 13 and older, and you must be 18 or older to opt into text messages. To send a tip, you must be old enough and authorized to use your payment method. We don't knowingly collect information from children under 13 — if you believe we have, email us and we'll delete it.
13. If you're in the EU or UK (activates with our European launch)
Living Mixtape isn't offered to EU or UK residents yet. When we launch there, we'll complete this section with the GDPR-specific terms — the lawful bases for each use, the controller/processor split between Living Mixtape and artists, your GDPR rights (access, rectification, erasure, restriction, portability, objection) and how to use them, international-transfer safeguards, your right to complain to your data-protection authority, and our EU/UK representative if one is required.

If we change this policy in a way that matters, we'll post the new version here with a new effective date and tell you — by email or in the app — before big changes take effect. We keep prior versions available on request.
